CoolFly Ebikes

  1. ONLINE WEBSITE RETURN POLICY. In order to undertake a valid return, you must obtain written approval for such return from CFE which can be obtained by contacting CFE at mark@coolflyebikes.com Any Products sent back to CFE by you without the written consent of CFE shall be rejected and returned to you at your cost.
    1. Purchased Products that have not yet shipped shall be subject to a ten percent (10%) processing fee.
  2. eBIKE RETURNS.
  3. You have 3 days (72 HOURS ) of delivery AND PROOF OF MANUFACTURES DEFECT BY A PROFESSIONAL ELECTRIC BIKE REPAIR SHOP ( VIDEOS ,PHOTOS AND WRITTEN DOCUMENT. ) NO BUYERS REMORSE. You must contact CFE within THREE DAYS (72 HOURS ) of your receipt of the ebike. The ebike must have less than Three (3) miles on the odometer, be free of any wear and tear, dirt, dust, fragrance, or any other signs of use and must be in the same packaging and condition that you receive it and must include all items that were inside the box (charger, keys, hardware, etc.). You must receive prior authorization and a prepaid return shipping label from CFE. Any warranty issues must be allowed to be resolved prior to processing a return. Returns are not allowed after THREE (3) days of the delivery date. ALL Returns MADE ON THE WEBSITE are subject to a twenty-five percent (25%) restocking fee unless manufactures defect determined by professional bike shop no exceptions.
  4. CoolFly Ebikes is not a repair shop, after day 3 or over THREE miles the bike needs to be taken to a legitimate established bike shop ( not friend ). If a manufacture defect is determined CFE will work with the bike shop on resolving the issue.
    1. Pre-Orders and Backorders and Pre-Order/Backorder Cancellations. Our backorder process is for ebikes that have already been available but are temporarily out of stock. For all pre-orders and backorders, your credit/debit card will be charged immediately. There will be no delay in payment collection, regardless of when the item is expected to ship.
    2. Accessory and Replacement Parts. Any purchase of accessories or receipt of a replacement part under the Limited Warranty shall be eligible for return within thirty (3) days of receipt. Any returned accessory or replacement part must be unused, free of any wear and tear, dirt, dust, fragrance, or any other signs of use and must be sealed and unopened in the same packaging and condition in which you received it. You will be responsible for paying for shipping both ways and will be subject to a twenty-five percent (25%) restocking fee.
    3. Non-returnable/non-refundable Items. Used Products, batteries, special orders, sale items, gift cards and gifted orders shall not be returnable except in EXTREME cases of breakage/malfunction covered by our warranty, and then only after receipt of our approval for the return. “Built and Delivered” fees are nonrefundable.

  2. EBIKE PERFORMANCE. Please note that information regarding the expected range on a single charge on one of our ebikes is an estimate, not a guarantee. There are many factors that contribute to actual, real-world range for an ebike battery such as age of the battery, temperature, level of assist, speed, payload, and terrain. Given the right conditions, it is possible to get less than the expected minimum range or greater than the expected maximum range.
    1. Alteration. Any alterations, modifications, or other changes made by you to an ebike following your purchase which affect the safety, operation, or mechanics of the ebike shall void the Limited Warranty and shall be at your sole risk of harm.
  3. PAYMENTS. Our website is powered by Square Payments and all payments made by you to CFE are processed through Square payment portal. Payments may be declined or returned to you, in CFE’s sole discretion, for any reason or no reason at all. If we accept a pre-order of any Product, your account, credit card, or other payment mechanism will be charged upon approval by CFE, regardless of when your purchase is expected to ship. If any credit card chargeback of any amount is issued on an order, the Limited Warranty for that order will be paused until the chargeback has been resolved.
    1. Tax. All applicable taxes (including sales tax) will be collected on all orders where such taxes are required to be collected.
    2. Financing. For qualified purchasers, ebikes may be financed through CFE’s consumer financing partners. The necessary qualifications for financing an ebike purchase, and your rights and obligations associated with such purchase, are solely determined by the consumer financing partner. It is your responsibility to review and understand all terms and conditions associated with financing an ebike purchase, and you hereby acknowledge that CFE is no way responsible for any such financing.
  4. LIABILITY. WE ARE ONLY LIABLE TO YOU FOR LOSSES WHICH YOU SUFFER AS A DIRECT RESULT OF OUR BREACH OF THESE TERMS AND WHICH ARE REASONABLY FORESEEABLE. OUR LIABILITY FOR SUCH LOSSES SHALL BE NO MORE THAN THE AMOUNT OF PURCHASE OF OUR PRODUCTS GIVING RISE TO SUCH LOSSES. WE ARE NOT LIABLE FOR ANY OTHER LOSSES. THESE TERMS DO NOT EXCLUDE OR LIMIT OUR LIABILITY (IF ANY) FOR: (i) DEATH OR PERSONAL INJURY CAUSED BY OUR GROSS NEGLIGENCE; (ii) FRAUD; (iii) FRAUDULENT MISREPRESENTATION; OR (iv) ANY MATTER WHICH IT WOULD BE ILLEGAL FOR US TO EXCLUDE OR ATTEMPT TO EXCLUDE OUR LIABILITY. YOU MA Y HAVE OTHER RIGHTS GRANTED BY LAW AND THESE TERMS DO NOT AFFECT SUCH RIGHTS.
Assembly
  1. CoolFly Ebikes does not offer assembly and will not be responsible for a poor / faulty assembly if you request , pay-for or purchase an assembled ebike it is the riders and owners sole responsibility to inspect all parts prior to riding. It is recommended to have a professional check over or assemble your bike.
We recommend contacting your insurance provider to determine if your current insurance policy would cover you in the event of an accident WARRANTY For your reference, please refer to below comprehensive warranty: 1. Frame – are warranted to be free from defects in material or workmanship for 90 days. Paint finish is considered consumable and is not part of the warranty. 2. Display, Controller and Motor Assembly – are warranted to be free from defects in material or workmanship for a period of 90 days from purchase. The Chain Guard is excluded from the 90 days Warranty 3. Original Batteries – are warranted to be free from defects in material or workmanship for a period of 90 days from the date of purchase as follows: full replacement during the first 90 days. The battery is sealed and cannot be opened or fixed. The battery should not have a percentage of nominal charge retention of 60% or less. Misuse of the battery, negligence or attempt to open or repair it will void the warranty. 4. General: The bicycle is backed up by a 90 days main warranty, certain components listed on this chart or consumables may be subject to a different period of coverage or not included in this warranty. The Chain Guard is excluded from the 90 days Warranty. 5. Consumables: Components subject to wear are not covered by the warranty: Tires, inner tubes, brake lines, brake pads, basket, wheel lining tape, light bulbs, LEDS, fuses, etc. Exclusions: The other parts are Normal wear parts which are excluded from this warranty. If any parts happen to be damaged during shipping, please contact us immediately after shipment arrival (24 hrs ). We will work with you to fix the issue. Please note that for warranty issues, the customer is responsible for the cost of labor to install warrantied components, however, we will cover the Shipping costs of warranty parts. If the warranty is void for any reason the customer shall bear any repair or replacement costs resulting from vehicle misuse, negligence or abuse. Always follow care and preventive maintenance procedures. Always keep receipts from any services performed to the vehicle by an authorized distributor or service center. The warranty will be voided by any of the following circumstances: 1. Failure to follow all directions or recommendations listed in the user manual. 2. Cycling collision, accident or vehicle damage caused by careless parking 3. Acts in violation of laws 4. Never registered your ebike 5. DIY repairs on electronics 6. Abusive use the bicycle in off-road terrain, mud, snow, water, sand, gravel and water 7. If the bicycle is used as rental unit 8. Damages caused by natural disasters such as earthquakes, lightning, fire, flooding and other hazards . 9. Rust and/or paint fading caused to heavy exposure to rain, hail, snow or direct sunlight for prolonged periods of time. 10. Overloading beyond recommended capacity . 11. Damages caused by nails, needles, broken glass , debris , sharp rocks or other foreign objects . 12. If the bicycle is used but not limited to stunts, jumping from ramps, stairs or elevated ramps. 13. If vehicle is used in competitions or racing. 14. If vehicle has been modified for any purposes on the motor, electrical system, suspension frame, and battery. 15. Use of other components not approved by the manufacturer. Damages resulted from improper care and handling. Due to the nature of the product some components must be exclusive from the manufacturer such as but not limited to the battery, motor, main gauge cluster, controllers, Led headlights, brake drums or disc rotors and pads etc. Other components such as tires, tubes, saddle, racks, baskets may be used from market-ready or compatible products previous approval from the retailer or manufacturer.   1. Normal wear and tear of any Covered Component.
  2. Consumables or normal wear and tear parts (including without limitation tires, tubes, brake pads, cables and housing, grips, chain and spokes).
  3. Any damage or defects to Covered Components resulting from failure to follow instructions in the ebike owner’s manual, acts of God, accident, misuse, neglect, abuse, commercial use, alterations, modification, improper assembly, installation of parts or accessories not originally intended or compatible with the ebike as sold, operator error, water damage, extreme riding, stunt riding, or improper follow-up maintenance.
  4. For the avoidance of doubt, CFE will not be liable and/or responsible for any damage, failure or loss caused by any unauthorized service or use of unauthorized parts.
  5. The Battery is not warranted from damage resulting from power surges, use of an improper charger, improper maintenance or other such misuse, normal wear or water damage.
  6. Any products sold by that is not an ebike.
DETERMINING WHETHER DAMAGE OR DEFECT TO AN EBIKE OR COVERED COMPONENT IS PROTECTED BY THIS LIMITED WARRANTY SHALL BE IN THE SOLE DISCRETION OF CoolFly Ebikes. Credit Card Chargebacks: If any ebike purchase becomes subject to a credit card chargeback in any amount, and you are still in possession of the ebike, then this Limited Warranty shall be invalidated until the credit card chargeback has been resolved. CLAIMS PROCESS: CoolFly Ebikes WILL NOT REPLACE ANY COVERED COMPONENT UNDER THIS LIMITED WARRANTY WITHOUT FIRST SEEING PHOTOS OR VIDEO OF THE DAMAGED COVERED COMPONENT. In order to exercise your right to receive a replacement for a Covered Component under this Limited Warranty, you must:
  1. Contact the CoolFly Ebikes Technical Support team by phone at 1-858-771-6682. The Technical Support team will initially work with you on the problem with your ebike to identify potential simple fixes.
  2. If the Technical Support team determines that a Covered Component must be replaced, they will provide you with a set of instructions for returning the defective Covered Component and receiving the replacement.
  3. After you receive the replacement Covered Component, the Technical Support team will also assist in determining how to replace or install the new Covered Component into your ebike.
You will be responsible for shipping costs associated with returning a Covered Component, unless CoolFly Ebikes agrees in writing to pay for such shipping costs. Replacement Covered Components under this Limited Warranty shall only be shipped to the address of the original purchaser
